Terms of Use
Effective date: [to be set on publication]
These Terms are a binding agreement between you and JG Commons ("we", "us") for your use of Capital Commons, its website and Android app (the "Service"). By creating an account or using the Service you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Education only: no investment advice
- Everything on the Service, including lessons, posts, messages, stock breakdowns, Q&A answers, mentor reviews, campaigns and market feeds, is for general education and discussion only. None of it is investment, trading, tax, legal or financial advice, or a recommendation to buy, sell or hold any security.
- JG Commons is not registered with SEBI as an investment adviser or research analyst, and neither are our mentors, moderators or members unless they say so and show proof. Badges, tiers and roles reflect community contribution, not qualifications.
- Investing and trading carry risk, including loss of your entire capital. Past performance does not indicate future results. Make your own decisions and consult a SEBI-registered adviser before acting.
- You alone are responsible for any investment, trading or business decision you make. We are not liable for any loss arising from reliance on content in the Service.
2. Eligibility and accounts
- You must be at least 18 and legally able to enter a contract in India.
- Membership is by invitation or admin approval. We may accept or refuse any request to join, at our discretion and without giving reasons.
- Give accurate details and keep them current. One person, one account. Do not share your password; you are responsible for all activity on your account.
3. Community rules
You must not post or send content that:
- gives buy/sell tips, "calls", target prices, or promises or guarantees of returns ("sure-shot", "risk-free", "assured");
- promotes pump-and-dump schemes, market manipulation, insider information, or any unregistered advisory, signal or portfolio-management service;
- shares phone numbers, Telegram or WhatsApp group links, or otherwise moves members off the Service for paid or unregulated services;
- is unlawful, defamatory, harassing, hateful, obscene, or infringes anyone's privacy or intellectual property;
- impersonates anyone, contains malware or spam, or tries to break, scrape or overload the Service.
We may filter, block or remove content that breaks these rules, automatically or manually.
4. Your content
- You keep ownership of what you post. You grant JG Commons a worldwide, non-exclusive, royalty-free, transferable and sub-licensable licence to host, store, copy, display, adapt (for formatting and display), and distribute your content to operate, improve and promote the Service. This licence ends when you delete the content or your account, except for copies other members already quoted or shared, backups kept for a limited time, and content we must keep by law.
- You confirm you have the rights to everything you post and that it does not break these Terms or any law.
- Content from members is their own view. We do not check it for accuracy and are not responsible for it.
5. Moderation, suspension and termination
- We may, at our discretion and with or without notice, remove content, limit features, pause or end any account, or refuse service to anyone who breaks these Terms, harms other members, or exposes JG Commons to legal or regulatory risk. Where reasonable, we will tell you why.
- We have no obligation to monitor content, but we may review content reported to us or flagged by our filters.
- You may stop using the Service and delete your account at any time.
6. Our rights
The Service, its design, software, lessons, curriculum, brand names and logos belong to JG Commons or its licensors. You may use them only through the Service for personal, non-commercial learning. Do not copy, resell, or republish lessons or other Service content without our written permission.
7. Changes to the Service
The Service is currently free. We may add, change, pause or discontinue any feature, or the whole Service, at any time. If we introduce paid features, we will tell you the price and terms before you are charged.
8. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties, express or implied, including that the Service or any content is accurate, complete, current, uninterrupted, secure or error-free, or fit for a particular purpose. Market data, feeds and third-party links are provided by others and may be delayed or wrong.
9. Limitation of liability
To the fullest extent permitted by law:
- JG Commons and its owners, team members, mentors and moderators are not liable for any indirect, incidental, special or consequential loss, or for any trading or investment loss, loss of profits, data or goodwill, arising from the Service or any content in it;
- our total liability for any claim relating to the Service is limited to the greater of ₹1,000 or the amount you paid us in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited under Indian law, including for fraud.
10. Indemnity
You agree to indemnify and hold harmless JG Commons and its owners, team members, mentors and moderators from any claim, loss, penalty or expense (including reasonable legal fees) arising from your content, your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
11. Governing law and disputes
- These Terms are governed by the laws of India.
- Before starting any formal proceeding, contact us at jgantony.fin@gmail.com and allow 30 days to resolve the dispute informally.
- Any dispute not resolved will be finally settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement (or, failing agreement, as the Act provides). The seat and venue is [Chennai, Tamil Nadu], and the language is English.
- Subject to arbitration, the courts at [Chennai, Tamil Nadu] have exclusive jurisdiction.
- Claims must be brought individually, not as a class or representative action, to the extent the law allows.
12. General
- We may update these Terms. We will post the new version with its effective date and, for material changes, notify you in the Service or by email. Continuing to use the Service after a change means you accept it.
- We may assign these Terms to an affiliate or a successor of the Service. You may not assign them without our consent.
- If any part of these Terms is unenforceable, the rest stays in effect. Our not enforcing a right is not a waiver of it.
- These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- Notices to you may be sent by email or in the Service. Notices to us go to jgantony.fin@gmail.com.
